Just when you thought you had mastered Ontario’s construction lien legislation, more changes are on the horizon. The Province is set to amend the Construction Act once again, with updates expected to take effect in early 2025.

Join Jason J. Annibale and Kailey Sutton of McMillan LLP’s National Construction and Infrastructure Group for an engaging discussion on key updates, including:

  • New rules for the release of holdback obligations,
  • Broader access to adjudication,
  • Design services potentially attracting lien rights, and
  • Revised definitions for “proper invoices” and “price.”

Jason Annibale is McMillan LLP’s National Co-Chair of the Construction and Infrastructure Group and a partner in the firm’s Advocacy and Dispute Resolution Group. He specializes in complex construction disputes and transactions, with a particular focus on the P3 and infrastructure sectors.

Jason is a Fellow of both the Canadian College of Construction Lawyers and the Construction Lawyers Society of America. He is consistently recognized as a leading construction lawyer by prominent legal directories, including Chambers, Lexpert, and Benchmark Litigation.

A regular speaker and author in the construction community, Jason also serves as the co-chair of Osgoode Hall’s premier professional development programs for construction law.

Kailey Sutton - McMillan LLP


Kailey is a Partner at McMillan LLP, specializing in construction, infrastructure, municipal, and land use planning law. She represents a broad range of development stakeholders, including owners, contractors, and consultants. Kailey’s expertise includes securing front-end development approvals and permits, drafting and negotiating complex municipal, construction, and development agreements, and advising clients on project delivery models, Building Code compliance, and other regulatory and development matters.

Recognized by Best Lawyers in Canada as “One to Watch” in Municipal Law and Real Estate Law, Kailey frequently appears before municipal councils, committees, tribunals, and Ontario courts. She is also a prolific author and speaker, actively engaged in the industry at large.
